Navigating the Environment Agency’s revised regulatory appeal procedure

The Environment Agency (EA) has recently updated its regulatory appeal process. The new approach introduces a two-stage system:

Stage 1 allows “customers” to contact the original decision‑maker within 14 days to address misunderstandings or correct errors quickly.

If concerns remain, Stage 2 offers a formal appeal within 28 days, reviewed by someone independent of the original decision.

Challenges with the new Stage 2 appeals portal

Working through the new portal for Stage 2 appeals has highlighted a few practical constraints that may affect others.

The portal currently restricts submissions to ten uploaded documents, which is often insufficient for more detailed appeals requiring multiple reports, plans, or evidence. Complicating matters further, ZIP files cannot be uploaded, removing the usual method of consolidating related documents into a single package with an integrated document folder structure.

To keep things moving, I’ve used a pragmatic workaround:

  • Renaming the ZIP file with a .pdf extension to bypass the restriction (it worked!)
  • Labelling the file so the case officer knows to change the extension back to .zip

In my case most of these zipped files were previously submitted with the Enforcement Undertaking offer, so there is at least a fallback if the portal struggles with my workaround.

Still, it underlines the need for the system to better accommodate the volume and variety of documentation often required at Stage 2.
