A stark reminder of the importance of compliance in road transport

The recent Traffic Commissioner decision involving CWM Transport Ltd and Transport Manager Lisa Murphy serves as a powerful reminder of why compliance cannot be treated as an administrative exercise. The case resulted in the immediate revocation of the operator’s licence, the disqualification of the transport manager and the indefinite disqualification of the operator and director from holding or applying for an operator’s licence.

DVSA investigations uncovered serious failings in vehicle maintenance, drivers’ hours management, tachograph compliance and overall compliance oversight. Fleet inspections found that four out of five vehicles inspected were prohibited, with evidence showing defects had been identified during maintenance inspections but not properly rectified before vehicles returned to service.

Most concerning was the discovery of widespread drivers’ hours infringements, missing mileage, suspected falsified tachograph records and indications of off-card driving. The Traffic Commissioner described the operation as having “no effective management of compliance systems at all.”

Analysis

The ruling highlights three key lessons:

  • Active engagement with compliance is vital

Systems, audits, downloads, defect reporting and maintenance controls must be regularly monitored. Having procedures on paper means little if they are not being followed in practice.

  • Do not overlook the responsibilities of the Transport Manager role

The decision reinforces that the Transport Manager is expected to exercise genuine and continuous control over compliance. Professional competence brings accountability and Traffic Commissioners expect clear evidence of effective management.

  • Culture is best imposed from the top

The most effective operators create a culture where safety, compliance and reporting are valued by everyone in the business. When compliance is ignored, the consequences extend beyond enforcement action and can ultimately threaten the survival of the operation.

The Traffic Commissioner concluded that the failings had created a significant risk to both road safety and fair competition. While every operator faces challenges, this case demonstrates the importance of robust compliance systems, honest engagement with regulators and leadership that prioritises safety above short-term operational pressures.

This decision should be viewed as a valuable reminder of the standards expected across the industry.
