Role - Solicitor

James joined Dyne Solicitors Limited in 2019. After 3 years of extensive training at Dynes, James qualified as a solicitor in March 2023. Working alongside and training under senior solicitors that are highly regarded experts in their respective fields has meant James is well-equipped to take instructions on a variety of cases across the core practice areas of the firm.

James manages his own caseload and works in collaboration with other solicitors in the practice so has a good understanding of the current work streams and employs different strategies on a case-by-case basis to achieve the objective clients desire.

James has practice experience in:

Environment

  • Submitting enforcement undertaking offers
  • Requesting reviews of decisions to prosecute
  • Without Prejudice discussions with prosecuting authorities
  • Abuse of process applications
  • Submitting freedom of information requests/environmental information requests
  • Statutory nuisance matters (both defending prosecutions and appealing abatement notices)
  • Preparing for interviews under caution
  • Magistrate court trials and crown court trials
  • Appeals to the Planning Inspectorate
  • Defending prosecutions brought under the EPR 2016/EPA 1990
  • Appealing various notices served by regulators
  • Defending water pollution prosecutions
  • Defending prosecutions under Trans-frontier Shipment of Waste Regulations 2007

  • Public Inquiries before the Office of the Traffic Commissioner
  • Motoring offence cases (e.g. speeding, drink driving, drunk in charge of a vehicle, running special reasons/exceptional hardship arguments)
  • Defence of police prosecutions involving agricultural vehicles
  • The Operator Licence Awareness Course (2-day course)

Commercial/Civil Litigation

  • Submitting claim forms, requests for judgment, applications for charging orders, applications for orders of sale, applications to cancel unilateral notices on properties, and applications for cancellation of registered charges
  • Registering foreign judgments in the UK
  • Breach of contract claims
  • Mediations that resulted in settlement agreements being signed and dealing with post-settlement matters
  • Debt recovery
  • Judicial reviews

  • Hosting the weekly free virtual legal advice 1-2-1 clinic via Zoom
  • Editor of Dyne’s monthly newsletter
  • Heavy Transport Association (‘HTA’) Coordinator. The HTA is the only specialist trade association for the special types/abnormal load industry
